What the 1 September 2026 DBS Rule Change Means for Foster Carers
On 1st September 2026 the Disclosure and Barring Service changed the safeguarding legislation to remove the supervision exemption for regulated activity with children. This affects a wide range of roles across children’s services, including fostering.
So, what is changing?
Under current rules, some individuals working with children are not considered to be carrying out “regulated activity” if someone else is supervising them. From 1st September, this exemption will be removed. As a result, more roles will legally fall under the definition of regulated activity.
This means that Enhanced DBS checks with Children’s Barred List information will be required for a wider group of people.
Why does this matter for fostering?
For foster carers, the change reinforces the importance of robust safeguarding and clarity around who is permitted to work with children in a regulated capacity. It may affect:
- Individuals supporting foster carers in the home
- Volunteers involved in children’s activities
- Professionals who interact with children as part of their role
